  • Current Employer & H1B petitioner (Onsite) r same but operates in 2 different names

    Hi,

Your suggestions will be highly appreciable..

    I have a quick query..

My offshore company and my H1 Petitioner are same management but operates in 2 different names. Say AAA and BBB respectively..!!

We develop our projects in offshore (AAA) while our client base is in onsite. Since both companies are functioning under different names, how complicated my Visa interview could be?

What are the documents I should carry incase if I need to give them a convincing reply..

    Pls advise.

    Thanks.

Your H1B petition was filed by the U.S entity (BBB). So technically they are your employer when you appear for the visa interview, although you will be employed with AAA at that time. What I mean is, if the visa gets approved and when you travel to U.S, your employer is BBB and not AAA. The VO might not even care about AAA. As long as the documents that you get from BBB are in order, you will have no issues.
Not a legal advice. Use of this information is strictly at your own risk.

I think you have everything to appear for the visa interview. Also, carry your tax documents for 3 years. If you want to carry a letter mentioning that AAA and BBB are companies within the same entity, then you can do that. There is no harm in carrying that letter. Most likely VO won't ask about that.
