  • H1 B query

In my case, I am working in Company A and got the petition number but still not stamped. Currently I got an offer with Company B and I have put my resignation in Company A.

Queries: (Note: I haven't stamped yet)
    1. Is it possible that Company A can withdraw my petition/work permit if I join in Company B . If yes should I apply again for H1B visa with lottery system in Company B

    2. I don't have the I797 document, I have only petition number is it possible for Company B to transfer my petition to new Company B

    3. After stamping should I travel at least once in Company A , is it possible without travel atleast once in company A I can transfer my petition to Company B

    4. How can I get I797 & Receipt number from the employer.

    5. What is Receipt number in which document I can find

    1. Yes A can withdraw. If you do not have the petition, then yes you would have to go through lottery again.
    2. Very low chances of getting that accomplished. Most big companies would want to see the approval notice.
    3. No its not necessary to travel for A.
    4. Its their petition and they have right to not give it to you.
    5. Its at the top of the approval notices.

This is my opinion not legal advice.
