  • Question regarding H1B Cap Exempt

    Can someone help me on this

    I was selected for H1B cap during 2012 and i was in USA from June/2012 to Aug/2014. Since then i am living in India, i heard about H1B Cap exempt and understand that I can still get the Petition extended till 2019. Can some one help me on how to get it extended or I should again apply for new lottery

    Find an employer who has a job matching your skill set and ready to sponsor your H1B. Give them a copy of your previous H1B approval notice and they will know how to transfer it (No need to go through CAP [quota] again). Once the transfer gets approved, you can attend the visa interview with the new approval notice. Once the visa gets approved, you can travel to U.S to work for your new employer.

      Basically i am not looking for any other employee, if i want to go to USA with my current employer and wanted to make sure before i talk to my resource management team

        Exact same process. The employer can file an extension based on the already expired petition. Once approved, you need to get the visa stamped and then travel.
