H 4 Visa best way to get it?

I came over to the US on a I-94 visitors visa Sept 2004 and got married to a US citizen oct 2004 we couldn't apply for the green card due to the fact that she doesn't make enough money (on disability ) and her parents will not co-sign. She is afraid that if I work under the co-sign part of the green card that her and her parents would be liable for breaking the law as well as being fined as she is on foodstamps and I automatically go on her case. Is there a way round this. We thought about the H 4 Visa. Please can someone help me out. Thanks

What is your present status? H4 visas are for the dependant spouses/children of H1B holders. Since your spouse is a US Citizen, you should apply for a K3 visa or get your spouse to file for an I 130 for you.
