  • H1 extension pending for more than 7 months..please advise

    Hi
    My employer filed H1 extension+amendment request on may 22nd and its been pending for over 7 months now.
    My I94 expired in October and its been 3 months since my i94 expiry.

    I read that we can stay up to 240 days after i94 expiry, is this correct what are the implications if my visa gets rejected.

    Does anyone have this scenario where H1 is stuck for long time, what are my next steps

    please suggest

    If your extension gets rejected, then you time in U.S past your I-94 expiry date will be considered to be illegal stay. Since it is already past 6 months, your employer should take an infopass appointment with USCIS to discuss your case. Check the USCIS web site for the current processing time of h1B petitions by processing center. Did you receive any RFE? If YES, then that could delay things further.
