Can I move to new Company when my Current company filed an extension for H1 B?

Hi,

I work for Company on H1 B visa which is valid till 10th Oct 2015 and my current company filed an extension on 24th Aug 2015. I am yet to receive the approval. Meanwhile, I got an offer from a new Company and I'd like to move. Considering the scenario where my current visa got expired and the extension has not been approved yet from my current company, Can I move to new company? Can new Company file the H1B transfer for me? What is the risk involved?

Assuming your I-94 has also expired on 10-Oct-2015, I would suggest you wait till extension is approved, upgrade to premium if you want a faster processing.
