    Hi Members,

    Very Happy New Year !! May God Bless All !!

    Kindly help me with your suggestions and comments on my condition.

    Recently my H1B Extension got approved and i got offer from a new employer (Say Employer B). But my current employer (Say Employer A) is not sharing the I797 Hard Copy. But i am sure that the case number (Receipt) belongs to me as i have got the approval email from Employer A (Which says who is the applicant, duration of extension, visa type and other things) which he got it from USCIS as my case was filed under premium processing.

    Kindly help me

    1. Can Employer B file for H1B Transfer without hard copy of I797?
    2. If so, what are the chances of approval or RFE or Rejection?

    You mentioned this is your extension. Do you have a copy of your initial H1B approval? You can use that to get exempted from CAP. The previous H1B approval notice and the current receipt number can be used while filing the transfer.

    You should get a copy of the latest H1B approval notice from your employer. It is your right. Without that how do you know if you are authorized to work or not. At least get a soft copy of the approval notice.
