  • H1B 221G | Change Employer

    Hello Friends,

On 7th Oct i was issues white slip and my case was sent to AP aka 221g. Submitted documents asked on 20th oct and since then there has been no updates. I keep on checking with NVC and Consulate but same standard reply.

Meanwhile my current organisation offered to file a cap exempt visa for me as i already have approved petition from external firm which went to 221g.

are there any such cases who have successfully got visa stamped after changing sponsor post 221g from the previous employer. Please help/suggest if that is the right way to proceed.

Any issue during the next interview with fresh employer?

Lot of people have done it successfully. Your current employer can file a CAP exempt H1B petition for you using your current H1B approval notice. Upon approval, you can schedule a new visa interview and attend that one. If your current is still under AP at that time, then you need to withdraw that application and mention as visa denied in DS160 that will fill later for the new employer.
