  • H4 IWP Question - H4 visa is still valid or expired within the last 12 months

    Hi,

I am going for an H4 visa stamping to India in Feb. Currently, I am on a stamped F1-visa (COS approved on Mar 2015 and stamping in May 2015). Prior to F1, I was on an H4 visa - not stamped but approved I 797 with a validity till Apr 2016. Since my nonimmigrant status in the US was H-4 till Mar 2015 (within last 12 months), would my answer to the IWP question "H4 visa is still valid or expired within the last 12 months" be yes/no?

Does "H4 visa" mean a stamped H4 visa? Would an approved H-4 I-797 be considered as an H4 visa?

    Thank you!

Yes it means "stamped visa" . An approved H4 I797 is not considered H4 Visa.

This is my opinion not legal advice.
