H4 Out of status or not?

hi guys, here's my case:

1. i-94 expired along with old passport
2. recently got new passport - renewal.
3. H4 Visa still valid same with H1B (spouse)


Am I considered Out of Status or not? Thank you.....

Yes, you need to Renew your I-94 ASAP at local CBP or just make a re-entry to the country..

Thanks! went to local CBP and explained to them my situation and they advised me to file for I-539 to extend my I-94
