H1B Out of cap eligibility

My previous organization has filled H1B for me and the petition is valid till 8/27/2015 and I left my previous organization before scheduling my visa interview.
I am having the I797 petition copy for the same.

Also I had H1B stamped for the period 10/01/2008 to 07/24/2011 for which I had not made a travel.

Please let me know the possibilities If my new company can take up under H1B Out of cap or can I go for fresh nominations in 2016.

You will not be eligible for cap-exempt petition since you have not actually worked for any of those petitioners in the US.

I think you will come under cap exempt. Contact any employer who is willing to sponsor you.
