H1B visa expiring
Hi,
My H1B visa and petition are both expiring in March 31st, 2016. I am having trouble getting them extended through my current employer.
My spouse is in Dallas with valid H1B for which I need to travel soon and work there. I still have 4 more years left on my petition.
I would like to know what are the best options out of below and procedure to get it done.
1. Quit current employer, apply for H4 through spouse, travel to US as a dependent and convert H4 to H1 through a US consultancy.
2. Quit my current employer and apply through a consultancy in India for fresh H1B petition/visa.
3. This option may not happen but I am aware it is there. The immigration team with my company suggested to go for Out of Cap petition filing if I miss the deadline to file for an extension. What is the deadline to file extension from India given my case? And how long does Out of cap process take to approve?
