Hi, my h2b visa extension was denied. We are planning to file a motion. Questions are, are we allowed to stay during the motion? Are we allowed to have 180 days after the renewal decision? In case the motion is denied and I stayed more than 6 months after my I94 expired, am I incurring a three year ban or am I exempted because of the filing of extension and motion? Please clarify thank you.
