Hi, I am currently on H4. One of the employers applied for my H1 (2016 Cap) and received a denial notice couple of days back and my employer is planning to appeal on the denial by applying 290b (Notice of Appeal or Motion). On a seperate note, my spouse I140 was filed in premium couple of weeks back. My question is can I still apply for H4-EAD as soon as my spouse I140 is approved while 290b is in process. Please respond. Thanks in advance!
