  • Can I do H1B extension while H1B amendment is pending

    Hello Friends,

    My H1B amendment is pending for about 3 months and I would like to file H1B extension since my validity is expiring soon.

    Can I file H1B extension while my H1B amendment is still pending.

    Can you please suggest?

    Yes you can but it will not be approved unless amendment is approved first. Would suggest to upgrade the amendment request to premium.

        Running into the same scenario employer asking for making the extension premium and not the old amendment

        What will happen in this case ??

          Here is the story, if the initial petition expires (end date 11/2016) then the amendment (filled 07/2016) has no value and the extension (filled 11/2016) is considered as an new application.

          The dependency does not exists between the two ..how true is this ??
