  • H1 B Amendment filed through Premium Processing - RFE for SOW

    Hi,
I filed for H1-B Amendment for a client location change through Premium Processing by my employer. I received an RFE after the 15 day period for Premium Processing for additional documentation for SOW. The Client has not signed the SOW with my employer but they are planning on having a long term contract (this is unpredictable - since they have been stalling for the past few months). For this reason, my company is contracting with a 3rd party firm that is dealing with the client till the contract is signed. I have an urgent need to travel to Canada (where I have my Permanent Residency) and plan to travel in the first week of April 2016 for my visa stamping in Ottawa). I plan to wait in Canada till I have my I-797 approval before going for the stamping. My previous I-797 is valid till February 2018. If the documentation is sent with the conditions and is not signed, or if an alternate document is submitted mentioning that the contract may be signed soon for a long term contract and if it isn't I'll be assigned on an in house project with the company (since I'm getting paid my regular salary regardless of the project), is there a chance of refusal ? My company is an American Consulting company with about 15,000 employees. The LCA has my Employer address and residential address (if I work remotely) in addition to the Client's work location. Thanks.
