  • Annual salary less than Rate of Pay mentioned in LCA

    Hi,

I am currently on my F1 OPT STEM extension. My employer is filing for H1B for me. In the Labor Condition Application (LCA), in section F - Rate of Pay, it is written:

"Wage Rate (Required): From: $73424 To: N/A"

(The above figure is actually the Prevailing Wage for my job/qualifications/location.) However, my annual salary is only $65000. What does this mean for me?

I understand, for H1B, I must be paid at least the Prevailing Wage. Does this come into effect after my H1 status comes into effect? Or can I ask them about it now that they have mentioned the above Rate of Pay in the LCA?

    Please advise.

    Thanks.
