  • Possible gap of H1 Extension i797 Start date and previous i797 expiry date

My H1b was expiring on 13th March, 2016. My extension was filed on 14th April, 2016 with USCIS and it got approved on 27th April, 2016. I am waiting for my new i797 and I am hearing that it could have 27th April, 2016 as the start date.

This means there is a gap of 14 days between my current i797 and new i797. Is this a problem during my next stamping?

Note: The extension was filed on 14th April, 2016 with USCIS and my visa expiry date was 13th April, 2016.

Why was it filed on the last day ? Yes, USCIS may approve it only from 27th April 2016 onwards. It most probably will not be an issue, but depends how the officer looks at it especially during GC processing.

This is my opinion not legal advice.
