  • I-140 question & job change

    Hi,

    My H1B ends Jan 2017. My Perm got approved about two months ago and my I-140 is in process now (regular filing).
    Assuming my I-140 is approved by August 2016, my questions are:

    I want to change jobs. So do I really need to wait for my current company to file for 3 years extension and then transfer my H1B based on my approved I-140 ?
    OR can I directly change jobs without waiting for my current employer to file for my 3 year extension based on my approved I-140?

      I would definitely advice you to wait until the I-140 gets approved and then change employers based on the new I-797.

      Always having I-797 with more validity (end date) has its own advantage.

      You could have done I-140 through Premium processing, which would have taken only couple of weeks.

      When you switch employers, you need to redo the Labor and I-140 again.

        Will I be getting new I-797 whenever my I-140 gets approved ?
        So the moment my I-140 gets approved, can I quickly change employer even without my current employer filing for my 3 year h1b extension ?
