  • Re-Stamping the H1B visa after change of employer and issues with initial H4

    Hi,

I am on an H1B visa and recently I changed my job and received the a new I-797 approval notice from my new employer.
I have a valid visa stamping in my passport till 2018 and my visa has my old employer name on it. Below are my questions.

    1. I am travelling outside US in the month of August. Do I need to re-stamp my visa with the new employer or as my old visa is valid till 2018, I can still travel to US with my old visa and new I-797 approval notice.
    2. I am getting married in the month of August, My wife will be attending for H4 stamping, Will she be refused to approve H4 visa because I don’t have a new stamping in my passport with the new employer name.

    Please advice,
    Thank you.

      1. No.
      2. This in itself will not be the reason for H4 refusal.

This is my opinion not legal advice.

Re-Stamping the H1B visa after change of employer and issues with initial H4

        Hi raghavi,

I have the my previous employer name and petition number on my current visa. someone told me I need to go for re-stamping. Please suggest me if this is ok or is it mandatory to attend the interview.

        Thanks!
