    Hi,

    Can someone please guide me for below query?

    My H1B was applied by a resourcing company back in April 2013 and I have got H1B stamped on my passport in October 2014 with validity period until October 2016.

    I never joined that employer and never went to US on that H1B visa.

    However in April 2016 I had to travel to US for some business purpose and applied for B1 visa and as a result of that B1 stamping, my H1B stamp was cancelled and in May 2016 I got an email from USCIS saying that "we revoked the approval of your case, Receipt Number YYYY YYYY YYYY X, and mailed you a revocation notice. It explains the reasons for our action."

    I think the company who applied my H1B requested USCIS to revoke my case approval.

    Now i want to use my current employer to get my H1B sponsored. Question is as i never used H1B, am i still be cap exempted and can my current employer can still apply my I129 as a cap exempted resource?

    It seems that your Cap Case was revoked and not withdrawn, this means your Cap case is no longer valid and you will need a new Cap Number.
