  • How to reset H1B clock

    Hi,

    1. Can I reset H1b clock if I leave the USA for one year after 5 years on H1b instead of using all 6 years?
    2. Can I be in any country I want for 1 year or do I have to be in my home country?
    3. After 1 year I will apply for new H1b. Do I get 6 years again or do I only get 1 year (because I reset the clock after only 5 years)?
    4. Can I apply for new H1b if I have not completed 1 year outside US yet, as long as I will have completed it at the time when my new visa starts?
    5. Are there delays to get new H1b after resetting the clock and coming back or do i actually only have to leave 1 year?

      1. If by reset you mean getting fresh 6 years of H1, then thats not possible by merely staying out for a year. In order to get fresh 6 years eligibility you would need to file a fresh H1 under a new cap .
      2. Outside US , doesn't matter where.
      3. Read answer 1.
      4. The one year period is between your last date in US and application of next petition.
      5. What kind of delays?
