  • H1-B transfer after I-140

    Hi All,
I am at 6th year of my H1-B. My present visa (I-797) is expiring on Jan 2017 (lest say case-A). I have received I-140. After my I-140, I applied for H1-B extension which is valid from Nov-2016 to Nov 2019 (Case-B). I got offer from a company last week (July 2016).

Question-1: How can I transfer my visa to new company using case-B now? It is valid from November-16.

Question-2: Or I have to transfer case-1 now and then case -2 in November?

    Regards,

    Ac21-104 change of employer

You can transfer your H1B status. Just tell your new company that you are eligible under AC21-104 with indefinite extensions of up to 3 years. However, consider filing your 485 as soon as possible.
This is purely my opinion and does not constitute legal advice.
