  • H4 Validity is different than that of primary applicant

    Hello Everyone,

I have filed two applications back to back for H1-B extension, Please have a look at below dates and advice.

I filed H1-B extension last year in 2015 and I-797 approval notice which I received from USICS shows different date of validity for H1-B applicant( primary applicant) and dependent.
    H-1B applicant validity dates are: 1 Jan 2016 to 31st Dec 2016
    H4 dependents validity dates are: 16 Nov 2015 to 15 Nov 2016

This year (2016) I also filed for premium extension (As I had plan to go to India in Dec 2016). For newer applications validity dates are:
    H-1B applicant validity dates are: 1st Jan 2017 to 31st Dec 2018
    H4 dependents validity dates are: 1st Jan 2017 to 31st Dec 2018

So there is a GAP of 45 days (16 Nov 2016 - 31st Dec 2016) for dependent H4 I-94 validity. I am not sure what to do? Could you please suggest me.

I came to US on H1B visa in Aug 2014 and still I have lived only two years in US.

    Thanks,
    Gaurav

      Thanks for replying Raghu.

Passport is valid up to 2020 for both - primary applicant as well as for dependent/H4.

Cant understand why the two (H1 and H4 I797) went out of sync, did you two travel out at different dates?

What are the visa expiry dates?

This is my opinion not legal advice.

Visa for primary applicant as well as dependent has already expired in 2015 year end.

I am also not sure why it went out of sync in first place. Can not find any relation.
