  • Using remaining time on H-1B

    Hi,

I was on H-1B from Feb. 2007 to Sep. 2010. During this time I switched 3 employers. H-1B transfer petition was filed by each employer. The start and end dates of employment on H-1B are:

    Employer 1: 2/3/2007 to 1/11/2008
    Employer 2: 1/14/2008 to 4/25/2008
    Employer 3: 4/28/2008 to 9/3/2010

I have been living outside the US since then. I still have about 2 years and 5 months left on my H-1B. My question is whether I can use the remaining time on my previous H-1B and if yes, by when should a new petition be filed for the same?

    Thanks.

Sorry, the details were incorrect. I was in the US till Sep 2010. My last day of work on H-1B was 9/3/2010.

I believe you will be cap exempt only till Sep 2016, 6 Years from your last held H1 status date.

This is my opinion not legal advice.
