H4 visa to be renewed while H1B is in process for the same person.

  • H4 visa to be renewed while H1B is in process for the same person.

    I am currently staying in US in H4 visa status which will expire by end of September 2016. In the mean time , my H1B Case got picked in lottery and is currently going through RFE process. As my H1B RFE result is not yet published by USCIS, I am thinking of renewing my H4 Visa ASAP to avoid any visa expiration issue. In this scenario, I am curious to know whether it is legally valid and safe to renew my H4 Visa while H1B Visa is still under process. Please help me urgently.

    H4 visa renewal is needed while H1B is in process for the same person??

    Hi Maria,

    I am also in the same boat. Did you apply for H4 renewal?

    my case is :

    I am in H4 visa which will expire by December 2016. My H1B is filed in April'16, Its picked and but the current status is "Case transferred".

    I am thinking of renewing my H4 Visa. Since h1 approval is taking time.

    But if I get my H1 approval while my h4 visa renew is in process then is what is my H1 visa status?

    Could any one please tell me how to proceed further in this scenario.

      Upgrade H1 to premium and ensure it is a COS. If approved move to H1 and you must work and get paid, if denied or approved as consular process, then based upon your comfort file H4 extension or leave US and re enter in H1 status after H1 stamping.
