Hello,
I am currently on an H1B visa which expires December 15th. My employer has verbally informed me that my position will be eliminated October 30th. I already have a B1/B2 visa in my passport (I entered on it when I came to interview for this job). I own a home in the US and would like a little more time to look for a new job / pack up my life and rent my house, etc.
1. Should I apply for a change of status to B1/B2 on the last day of my employment and stay in the country until December 15th
(when my I-94 expires)?
2. If I don't apply for change of status and leave the US instead, what are the chances I would be allowed to re-enter on my B1/B2 visa (given that I am now not working for my employer?)
3. If I do find a new employer to transfer my H1B to before October 30th, would I still need to leave the US and re-enter in order to get a new visa stamp (my current H1B visa expires December 15th so will need renewal)
Thank you!
