  • Fresh H1B petition transfer outside US

    Hi,
Apologies for asking some similar question but I believe getting experts opinion is best that too specific to individual's case.

Q1: H1B petition was approved by Employer X processed with old passport (#XYZ123). In the meantime, my passport got expired or name change on my passport. Is it possible to get it transferred to other employer with new passport (#ABC456)?
If above is Yes, then applicable..
Q2. Is it possible for more than one employers to raise a H1B transfer request at the same time? Any priorities on which one will be picked up first?
Q3. How much time it takes to get it transferred?
Q4. If an employer has to INITIATE for H1B petition transfer? Do they need any documents from me apart from I797B copy (for example, passport copy etc)?
Q5. Suppose petition is approved for 3 yrs, till then any new employer can go for a transfer?

    Regards,
    Nitin

    1. Yes.
    2. Both will get processed and decided upon independently based on their own merits. If both raised under same category, if one is filed as premium it will be taken up first. If you get both approved simultaneously, you will eventually have to decide with which to go for first while booking visa appointment.
    3. 2-4 weeks in premium, 2-4 Months under normal processing.
    4. I797B, passport, educational credentials. https://www.immihelp.com/h1-visa-stamping-documents/
    5. It depends how long they can show work for you.

This is my opinion not legal advice.
