  • H1B Cap exempt & LCA process

    Hello All, Greetings.

My H1B petition was approved in 2014 and expired in October 2015. I didn't get chance either to travel or for H1B visa stamping.

In April 2016 - H1B Cap exempt renewal was initiated in "normal" mode.
In October 2016 - My employer has agreed to convert it to "premium" mode. SLA for this renewal is 3 weeks.

While the petition renewal is in progress, i need some clarifications from the experts.

My work location in original petition in 2014 is: Boston
H1B cap exempt filed (under normal mode) in April 2016 is: Texas

But, after the premium renewal, planned work location is: Newyork.

Considering the above scenarios, post H1B cap exempt renewal i would need to process LCA. But, i heard that, off late USCIS is mandating petition amendment (if visa stamping is not done) rather than LCA.

Can you please shed some light in this matter? and the course of action i should take?

    Thanks in advance.

    Chakri.
