  • Help with H1B (Layoff)

    Hi,

I am on an H1B which is valid till march 2018 and was extended based on an I 140 which my employer holds. My employer changed ownership and as a result I was laid off from work. My employer is ready to keep me in pay roll for about 8 - 10 weeks.

    Here are my questions :

    1. In case if I am unable to find a new job within this period, will I be able to move to my wife's H4 (my wife has a separate H1B) for the time being and then reactivate my H1B when I get a job ?
2 .Also , how long does it take for H1B to H4 conversion and is it possible to do a premium filing ?
    3. If I move to H4 will I be eligible for unemployment wages ?
    4. I only have a scanned copy of my I 140 , should I get the original from my employer ?
    5. Will my H1B with the current employer be active as long as they process my payroll ? Lets say if I agree to go on an unpaid vacation , so my paycheck might not show any salary being paid , will my H1B be still valid ?

Any help/advice will be greatly appreciated.

    Thanks
    P
