Hi All,
I require your help in my case.
I am on H1B and stayed in US for 3 years and current visa and I94 got expired on October 2016 and my visa extension is filled before the date of visa expiry. However, my visa extension went to RFE and my employer is going to respond in next week . Last date for RFE response is 12th Jan 2017. My employer is also trying to file a new extension with different client as well.
My question is -
1. If my current extension gets rejected (Because if it is not received in time or any other reasons) and my new extension case is not received to US, can I stay in the country ?
2. If my current extension gets rejected and my new extension case is received , can I stay in the county ?
