  • H1B Cap Exemption - Transfer clarification needed

    Hi Guys,

    Please clarify my below question.

Initially, I have got H1B visa through X employer on dec 2014, it was approved for only one year, I have the I797 Petition with me. Since there is no employment opportunity with that employer, i transfer my H1B visa to another consultant called Y. It was also approved for one year and its validity got expired on Aug 2016, due to my family issues i could not travel though there is opportunity, I have I797 Petition for this employer also. Since they said they could not re-apply, i again transfer the petition through "Z" employer. It was also approved for one year. But Z employer does not have US opportunity now, also my petition is going to expire on coming october, also they are not ready to give I797 petition (they are asking 3 lakhs to give petition). If i want to transfer to another employer, do i need I797 copy from Z employer?. or shall i apply transfer based on Y employer petition?.

    Here i summarised my problem.

    1) X employer - H1B expired on Dec 2015 - I have I797 copy - did not travel
    2) Y employer - H1B expired on Aug 2016 - I have I797 copy - did not travel
    3) Z employer - H1B going to expire on Oct 2017 - I don't have I797 copy (also i dont know receipt number)

If i want to transfer again do i need I797 copy from Z employer? , or shall i apply transfer based on Y employer's I797 copy?. I know i have complicated my H1B visa. But please help me guys.
