  • H1B to L2(with OPT) visa process for starting new venture

    Hello,

    I would like to start a new venture in US but because I am on H1B I cannot do anything. My wife has L1B visa so I am thinking to change my visa to L2 and get OPT. Can someone help me to answer following questions.

    1. What is the process to convert visa from H1B to L2(with EAD)? And how much time will it take?
    2, Is it possible to get L2 and EAD at the same time or do I need to wait after L2 to get EAD?
    3. Do I have to quit my job in the middle of this process because of COS?
    4. Do I need to go back to my country for any reason may be for L2 visa stamping?

    I will really appreciate help provided by anyone.

    1. File form I539 for COS to L2 and along with form I765 for EAD. It typically takes 3-6 Months for both to come by.
    2. It is possible to file them concurrently, whether you will get it together or not is anybody's guess.
    3. You cannot continue to be on H1 once COS to L2 is approved.
    4. Not required if you do not mind waiting for the COS to get approved.
