  • Job change in 6th year H1-B with approved I-140

I am in the 6th year of my H1-B valid until September 2017. I have an approved I-140 with my current employer (EB2 with priority date in July 2013). When is the soonest I can change my job, if at all?

    1. Should I wait until my current employer files an H1-B extension? Or,
    2. Can my prospective employer file an H1-B extension immediately using my existing approved I-140? Or,
    3. Is it best if I don't change jobs at all until my green card is fully approved (perhaps another 6 years!)?

You could have changed your job as soon as you got approved for the I-140. It wont go away.
This is purely my opinion and does not constitute legal advice.
