  • H4 Visa + H1B Petition approved

    Wife traveled US with H4 Visa and she is having H1B Petition approved with current Employer.can she work for the same Employer with the approved Petition copy or she has to get the stamping done.

    Please post the sequence of events (entry into US an H4, application of H1, approval of H1) along with the dates. Also did the H1 approval come with a new I94?

      Thanks Raghvi. She traveled to US in Feb 2017 , has her h1b petition is approved since May 2015 . Yes she has a new i94.

      Note : She already had her h4 visa stamped when her h1b petition was being processed and approved.

        If her last entry was in H4 visa, and had H1 approved before her travel into US, then she is currently in H4 status, her employer needs to file. COS from H4 to H1 and once that is approved she can work for the employer.

          Does COS have a time frame, meaning wether it has to be filed withing April ?

          Normally how much time does a COS take.?

            It can be filed anytime, it typically takes 3-6 months without RFE.
