    Hello,

    I am currently on H1b visa and the stamp on my passport has expired but I do have valid I-797 aas well have a valid DL. But, my children are younger so they currently do not have driver license, but both have valid I-797. So, when traveling to puerto rico they will need to use their foreign passports, will there be any issue when coming back to the USA from puerto rico? Which documents should I bring?

    Neither the visa nor H1b petition prove status. It's the I-94 that determines status, and that's what all of you should bring, to show that you are currently in status. If you got your status from entry, the I-94 is online. If you did Change of Status or Extension of Status in the US after entry, then the I-94 is attached to the I-797 approval of that COS or EOS application.
