  • I-94 shortened by 1 month from previous approval by USCIS

    Here are the date wise case details as follows:

    Previous approval:
    Entered in US – April 03, 2017.
    Visa on passport valid till – July 31st, 2017
    I-94 given by CBP on POE valid till -July 31st, 2017

    Recent approval:
    After that , Filed H-1B visa extension in Feb, 2017 and got new approval on 9th June with following dates

    I-797 – Valid from 02/02/2017 till 06/30/2017 -Shortened by one month from previous approval
    New I-94 from USCIS -valid till 06/30/2017

    Questions:
    • Now what are the options and till when he can stay in US with this situation?
    o File new visa extension before 06/30/2017 or July 31st, 2017?
    o Can CBP help to get an extension on current I-94?
    o Should he move out of country and enter back to get extension on I-94? If yes, should it be done before 06/30/2017 or July 31st, 2017?

    As per last action rule you are authorized to stay and work only till 6/30, if you intend to stay and work beyond that, then your employer needs to file extension before 6/30.
