H4 EAD Application for a F1 Student

Hi Friends,

My wife is currently on F1 status. Meanwhile i have my I140 approved. Can i apply for my wife's EAD based on my I140 while still retaining/continuing with her F1 status ? is it possible for a student on F1 to retain a H4 EAD simultaneously ?

Kindly assist if any one ever had this same query and if there was a concrete answer for the same.

No. Either your wife is on F1 or H4 status (which comes with its EAD). You cannot be in both statuses at the same time.

thanks. One more question here please:
is there a rule which mandates that H4 EAD should be applied after a certain period of gap from the day my I140 was approved ? or shall i go ahead and start the process ?

Note - consider the above question without the F1 situation stated earlier

You can start filing for H4 EAD.
