Hello,
I have a question on applying H4 for my wife. She was here in US on H1 visa and worked for 2+ years. Her H1 visa was expired in Sep 2016 and got the new approved petition until may 2018.
Now She returned to India as her client ended the project. I have few questions regarding applying H4 for her.
a) Can i apply H4 for her? If yes, what will happen to her approved h1 Petition?
b) What is the process of applying H4 when having approved H1 petition? Is that a status change H1 to H4 or fresh H4 application? Note that my H1 visa was also expired Sep 2016 and i'm going to India this month to get the renewal done. Is it okay if she goes to H4 visa interview before my renewal stamping done?
c) Can she change status to H1 after coming here on H4?
