  • Getting paid on 1099 while on H1

    Hi, I am currently working for company A on full time H1.

    However, I have another opportunity to work on my own time and earn some extra money from Person B, in addition to my full time job with company A.

    Would it be illegal to get paid like this from another payer using the Miscellaneous income form 1099?

    You can work only for those employers which are specified on H documents. Other wise it is illegal and will create trouble.

    Assuming that working with other employer is valid, it is OK to get paid on MISC-1099. The only difference is that there is generally no income tax deduction at source with 1099.
