  • H1B tranfer rules

    Hi,

If someone is working on H1B status in USA and get affected with lay off at job. What is the official grace period to find a new job in USA and what is the H1B transfer process and how much time it takes to stay in the status? What are the scenarios once the grace period gets over?

If you wish to continue to be in the US (with a new h1b job) - I would strongly advice you to get a new h1b sponsored job at the earliest, and with minimal gaps in your paystubs, to ensure that your h1b transfer to a new employer does not get denied.
If you wish to stay until you are legally allowed, and then leave to the home country, then the legal stay period is till your I-94 expiry.
Technically you lose the h1b status the moment you get laid off, and the duration of a gap in status does affect your h1b transfer prospects, so better be quick.
