Hello,
I am currently in the US on H4 Visa and have received I-797B approval notice from my employer in India to start working in US from October 1st, 2017. Should I remain in the US and ask my employer to file an amendment for change of status from H4 to H1B OR go back to India for Visa Interview and stamping? Which option is less risky and will get processed easily?
In case I go to India for stamping and get a RFE or under administrative processing, will I have to stay back in India till it gets cleared? How much time does it usually take for it to get processed? What will happen if I come back to US on H4 visa while RFE is being processed and it gets cleared later on. Will I have to go back again for stamping or I can receive the I797A approval notice while staying in US itself with the new I-94 number associated?
