  • Wage Levels in LCA

    I am working in USA from last 2.5 years. Recently, i was moved from location A to location B. My employer changed my wages as per company policy. However the wages were reduced almost 30%. I tried to find over internet how wages are defined for H1B visa holder. I found the wages are determined by the Wage Levels defined in LCA. I further research on LCA wage levels and found that wage levels are determined based on your education, experience & role. I found my employer always files my LCA as level I which is entry level job. I am having 10 years of industry experience. I asked my employer how come my wage level is I (entry level). Employer replied saying it is based on company policy. I argued that wage levels are not determined by company policy but as per guidelines provided by DOL. After inquiring through other colleagues ,i found employer is deliberately showing level 1 for most of the employees so he can pay less wages.

    Now, i am thinking about exploring legal options against employer to get appropriate wages. Can i register a complaint? Will this impact my Visa status, etc. Any help would be greatly appreciated.

    First find another job. Then, file a DOL whistleblower complaint through an attorney
