H1b transfer pending

My current company is sending offshore on 6th October 2017 There is employer who is ready to file my h1 transfer but he is delaying for a week or so to get approvals.

My question is

1. Can I willfully resign and stay here for 60 days without any problem for out of status?

2. Should i go back and come again after transfer is approved?
