H1B Transfer under cap exempt question
Hi,
I am staying in India and working with CTS.I applied for H1 through consultancy and got my H1 approved I797 form valid till March 2019. But did not scheduled for stamping yet. Just now got supporting documents from consultancy.
Here are my questions:
1) CTS is now ready to file H1 Transfer under cap exempt. But if CTS application gets rejected, can I still use Consultancy's I797 and go for stamping through Consultancy (provided consultancy did not revoked my I797)?
2) Also if CTS applicaton status goes to RFE or process gets delayed, can I go ahead for stamping with Consultancy or do I need to wait until CTS process completes?
