My employer filed a premium H1B recently and it has delayed for over 40 days. We contacted USCIS on the day 15th and they said that the case has been sent to the background check unit for security purposes. I had an arrest record followed by a deportation case, which was dismissed in the court with prejudice. I wanted to know how it is probable that the delay in the case is related to the previous deportation case. Moreover, since in I-129, it is not asked if you have had an arrest record, I did not disclose this issue with my employer's lawyer. I wanted to know if someone has had similar expeience and what you recommend at this time. Do you think if I disclose this to the lawyer, it will help the H1B case? I greatly appreciate your help in advance.
