Advice on below if someone was in same boat:
Spouse H4-visa stamp expired on Feb 2017 for the same company which I am still working on.
Spouse H1B (I-797)-approved in Jan 2017 and started working later applied for COS H1-H4 in October 2017 as we had a baby in July and spouse want to take a break form work.
Does I-797 approved means a new visa or only when we have a stamp on our passport is counted as a visa.
Spouse has to go India now due to personal urgency while COS pending. Is she eligible for DropBox as she has not had any H1-B stamping on passport based on below eligibility criteria for drop box:
I have a previous U.S. visa in the same class as the visa for which I wish to apply YES ( H4-Visa expired in Feb-2017)
My most recent visa was issued in India. YES
I received my visa after January 1, 2008 YES
My prior visa is not annotated “Clearance Received” or “Department Authorization”. YES
My most recent visa (in the same class for which I am applying) was issued on or after my 14th birthday. YES
I have no refusals for a visa in any class after my most recent visa issuance YES
If I am applying for an H or L (individual) or R visa, my prior visa in the same class is still valid or expired within the last 12 months. YES (H4 expired on Feb 2017)
