H1B Visa Expired

Hi All,

Want to share my case and get the opinion about same

My H1B visa was approved on Jan 2007 and expired on Jan 2010, but i have never traveled on same visa, also never renewed same.

Does that comes under cap exempt? is there something can be done?

Note: - I did traveled with B1 and L1A (stayed 3 years) after H1B expired

The new H1 has to be filed afresh, using the lottery. It will not be cap-exempt in your case.
