Can I work for my previous employer again, in case H1B visa transfer is denied?

  • Can I work for my previous employer again, in case H1B visa transfer is denied?

    Its been 5 months I have started working for new employer on transfer receipt still it is not approved yet. my attorney not recommended going for PREMIUM processing based on current scenario(h1b processing).

    I have a question just in case if my transfer denies what are all my options.

    1) Can I work for my previous employer ? he has not withdrawn/revoked the petition and it's still valid.
    2) If I can work for my previous employer I'll not have the paystubs for these many months won't it be a problem (will it affect anything to my status?)
    3) Currently my wife & kid is in india can they attend h4 visa interview on previous employer approved petition?

    2. As long as you have the paystubs from your current employer (where petition is pending), that is fine.
    3. Not right now. Yes, when you start working for them again.

      That gives me some confidence to upgrade my petition to premium processing, based on the decision I can schedule interview for my wife.
