H1b extension beyond 6 years based on family based green card

Hi,
I am on H1b visa with about 15 months left before my 6 year maxout is reached. My brother is a US citizen and he can file family based green card for me. My question is will my employer be able to extend my H1 visa beyond 6 years based on the green card application in process?

According to my Lawyer, they cant unless you have an Employer sponsored green card application on file. Better to start your family based sponsorship application right away
